VITANY – Distance Selling Agreement

This Distance Selling Agreement has been drawn up for sales conducted over the internet in accordance with the provisions of the Regulation on Distance Contracts, published in the Official Gazette dated 27.11.2014 and numbered 29188 .

The customer (“Consumer”) visits www.vitanyofficial.com By placing an order through the website, the customer acknowledges, declares, and undertakes that they have read, understood, and electronically approved all the terms and conditions of this agreement.

Article 1 – Subject

The subject of this agreement is the sale and delivery of the product, the characteristics and sales price of which are specified below, sold by the seller to the consumer, and the determination of the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on Consumer Protection and related legislation.

Article 3 – Consumer Information

Consumer information consists of the information provided during the ordering process:

  • Turkish Republic Identity Number

  • First Name / Last Name

  • Telephone

  • Email

  • Address

Article 4 – Information on the Product Subject to the Contract

The type, quantity, brand/model, color, number of items, selling price, and payment method of the goods/product/service consist of the information available at the time the order is confirmed.

Article 5 – General Provisions

5.1. The consumer declares that they have read and are aware of all preliminary information regarding the essential characteristics of the product(s) subject to the contract specified in Article 4, the sales price, the payment method, and delivery details, and that they have provided the necessary confirmation electronically.

5.2. The product(s) subject to this contract will be delivered to the consumer or to the person/entity at the address indicated, within the timeframe specified in the preliminary information, depending on the distance of the consumer's place of residence for each product, provided that this period does not exceed the legal 30-day limit. This period may be extended by a maximum of 10 days, provided that the consumer is notified in advance.

5.3. If the product subject to this contract is to be delivered to a person/entity other than the consumer, Vitany cannot be held responsible if the recipient refuses delivery.

5.4. Vitany is responsible for delivering the product in good condition, complete, conforming to the specifications stated in the order, and, if applicable, with warranty documents and user manuals.

5.5. Delivery of the product subject to this contract is conditional upon the Consumer electronically approving this contract and paying the price using the payment method preferred by the Consumer. If, for any reason, the product price is not paid or is cancelled in the bank records, Vitany shall be deemed to be relieved of its obligation to deliver the product.

5.6. If, after delivery of the product, the consumer's credit card is used by unauthorized persons due to no fault of the consumer, and the relevant bank or financial institution fails to pay Vitany the product price; provided the consumer has received the product, it is mandatory to return the product to Vitany within 3 days. Shipping costs are the responsibility of the consumer.

5.7. Vitany is obligated to inform the consumer if it is unable to deliver the product within the specified time due to force majeure or extraordinary circumstances such as adverse weather conditions or transportation disruptions. The consumer may request cancellation of the order, replacement of the product with an equivalent if available, and/or postponement of the delivery time. In case of cancellation, the amount paid will be refunded within 15 business days.

5.8. This agreement becomes valid after it is approved electronically by the consumer.

5.9. Prices for products on the Vitany website include VAT but exclude shipping costs. Promotional campaigns are subject to change without any reservations.

Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the contract within 14 days of the delivery of the product to themselves or to the person/organization at the address they specified. To exercise this right, Vitany must be notified by email or telephone within this period, and the product must be unused.

In exercising the right of withdrawal:

  • The product, along with the original delivery receipt and invoice, must be sent to Vitany.

  • VAT and legal obligations cannot be refunded if the original invoice is not sent.

  • Shipping costs are the responsibility of the sender.

The right of withdrawal does not apply to single-use products, hygiene and personal use products, underwear, swimwear, bikinis, socks, bras and other products that come into direct contact with the skin, or products that have been opened or used. The right of withdrawal also does not apply to specially manufactured or personalized products.

If payment was made by credit card, in the event of unauthorized use, the card issuer will refund the payment amount to the consumer within 15 business days of the dispute.

In case of disputes, Consumer Arbitration Boards or Consumer Courts in the consumer's place of residence have jurisdiction.

Article 7 – Shipping and Delivery

Shipping: Once the order confirmation email is sent, the products will be handed over to our contracted shipping company.
Delivery: Products are delivered to the specified address via the shipping company. Delivery time is a maximum of 7 business days from the order confirmation email.

Damaged packages should not be accepted, and a report should be filed with the shipping company representative. Once the package is accepted, the shipping company is held responsible.

Article 8 – Privacy Policy

VITANY SPORTSWEAR, operating at the address Cevatpaşa Mahallesi Özgürlük Caddesi Paragon Luxury Living İş Yeri 1/6 Merkez/ÇANAKKALE, can be reached by customers at www.vitanyofficial.com The company will not use the personal information provided through this platform for purposes other than those specified in the Privacy Policy, and will not share it with third parties without permission.

Users can update their personal information by logging into the site; they can also unsubscribe from promotional lists via email.

By visiting the site, each user agrees to the terms of this Privacy Policy.

Article 9 – Competent Courts and Enforcement Offices in Case of Dispute

Consumer Arbitration Boards or Consumer Courts shall have jurisdiction over disputes arising from the implementation of this agreement.

By placing an order, the consumer is deemed to have accepted all the terms and conditions of this agreement.
